Our client

Our client was in their fiftieth year at the time of the injury. They had undergone hip surgery in which a product was implanted, on the understanding that it would hold up and allow them to get on with their life.

What happened

The implanted hip product failed. As a result, our client had to undergo hip revision surgery, a further operation to remove the failed product and replace it.

The failure affected our client in three ways. There were the physical consequences of the failure itself and of undergoing further surgery. There were psychological consequences. And there were financial consequences. The claim was brought to address all three.

How the claim was investigated

Philip Treacy brought the claim against the manufacturer of the hip product. A claim of this kind is a product liability claim, brought under the Liability for Defective Products Act 1991, which allows a person injured by a defective product to pursue the producer of that product. The Act does not require proof of negligence: the question is whether the product was defective and whether the defect caused the injury.

An independent expert was instructed to support the claim. The evidence gathered addressed both the failure of the product and the consequences of the revision surgery our client had to undergo.

The outcome

The defective hip implant claim was resolved in July 2026 by way of a six-figure settlement, reached without admission of liability by the manufacturer. The settlement amount is confidential and is not published. The settlement concluded the claim without our client having to give evidence at a contested hearing.
