A settlement of €150,000 was reached in a cycling accident claim in Ireland on behalf of a man who was struck from behind by another road user while he was cycling. The claim was brought against the third party’s insurer and was resolved in July 2026 without admission of liability.

Our client

Our client was forty nine years old at the time of the accident. He was self-employed and, by his own account, a very active man. Cycling was part of how he lived his life, not an occasional thing.

What happened

Our client was out cycling when he was struck from behind by a third party. A cyclist hit from behind has no opportunity to see the collision coming or to take avoiding action.

He sustained injuries to his back, neck, shoulders, both wrists and both knees. Because he was self-employed, being unable to work meant an immediate loss of income, and he was out of work for six months. The effects were not only physical. Having been very active before the accident, he found it difficult to cope with not being able to be active, and the recovery was a long one.

How the claim was investigated

Rose Sweeney brought the cycling accident claim on our client’s behalf. A road traffic claim of this kind rests on the duty every road user owes to others using the road, and on establishing that the third party fell short of that duty. Personal injury claims arising from road traffic accidents are assessed by the Injuries Resolution Board before court proceedings can be issued.

An engineer was instructed to address how the collision had occurred. Several consultants were also instructed to deal with the range of injuries our client had suffered, across his back, neck, shoulders, wrists and knees, and to set out the likely course of his recovery. His loss of earnings as a self-employed person formed a distinct part of the claim and had to be evidenced separately from the injuries themselves.

The outcome

The cycling accident claim was resolved in July 2026 by way of a settlement of €150,000, reached without admission of liability. The settlement brought the matter to a conclusion without our client having to give evidence at a contested hearing.
