Our client, who was in their fiftieth year, went in for hip surgery expecting the ordinary thing: an implant that would hold up and let them get on with life. That is not what happened. The implanted product failed, and they were left needing revision surgery, a further operation to remove the failed product and replace it. The claim was brought against the manufacturer and resolved in July 2026 without admission of liability, for a six-figure sum that remains confidential.

The failure affected our client in three ways: the physical consequences of the failure itself and of undergoing further surgery, the psychological toll, and the financial cost. The claim was brought to answer all three.

How the claim was investigated

Philip Treacy brought the claim against the manufacturer of the hip product. A claim of this kind is a product liability claim under The Liability for Defective Products Act 1991, which allows a person injured by a defective product to pursue its producer without having to prove negligence: the question is simply whether the product was defective and whether the defect caused the injury. An independent expert was instructed, and the evidence addressed both the product’s failure and everything the revision surgery put our client through.

The outcome

The defective hip implant claim was resolved in July 2026 by way of a six-figure settlement, reached without admission of liability by the manufacturer. The amount is confidential and is not published. The settlement concluded the claim without our client having to give evidence at a contested hearing.
